Beyond the prestige associated with the Principality, protecting your trademark in Monaco is particularly important. French and European Union trademarks have no effect there. Any company that operates or plans to operate in Monaco therefore has an interest in specifically protecting its trademark in this territory.
The cost of registering a trademark in Monaco is relatively attractive compared with other Offices, notably thanks to a multi-class filing system. The official filing fee of €130 covers up to three classes of goods and/or services. Beyond that, each additional class incurs an official fee of €40. We of course provide complete, detailed quotes before any procedure begins.
Processing an application is very fast: under normal conditions, a trademark is registered approximately one to two months after filing. This makes it possible to consider international protection strategies within shorter timeframes.
Checking the availability of a trademark is not a legal obligation of the Office during the administrative examination of the registration application. Despite the absence of an opposition procedure, and in order to avoid any risk of infringement or unfair competition action by a third party holding earlier rights, it is preferable for the applicant to carry out a prior rights search. This will confirm the availability of the trademark for the goods or services concerned, that is, that it does not visually, phonetically or conceptually reproduce an earlier trademark.
