Why Register a Trademark in Monaco?
A French or European Union trademark has no effect in the Principality. That is why specific protection is necessary to enjoy exclusive rights there.
A Monegasque trademark registration also offers several other strategic advantages, such as:
1. Quickly securing one’s rights
Under Law No. 1,058 of June 10, 1983, ownership of a trademark is acquired through the first public and well-known use, but the owner cannot claim an exclusive right without filing and registration. Failure to register therefore creates a burden of proof if a third party uses the mark first.
2. Obtaining a registration quickly
Provided there are no irregularities, the registration certificate is generally issued within one to two months—a valuable timeframe ahead of a product launch or contract negotiations.
3. A Less Crowded National Register
The limited number of national trademarks in Monaco offers greater flexibility in choosing a mark, though this does not exempt the applicant from conducting a thorough search for potential conflicts: national or international trademarks valid in Monaco, company names, domain names, etc.
4. No administrative opposition
No opposition procedure exists prior to registration, which facilitates obtaining the trademark, without, however, eliminating prior rights, which may still be challenged in court.
5. No Revocation for Non-Use
Unlike under European Union law, an unused trademark cannot be canceled on this ground: it remains valid and may prevent the filing of a new application.
6. A Foundation for International Protection
Subject to certain conditions, a Monegasque trademark may serve as the basis for an international application through the Madrid System (WIPO), which remains linked to the Monegasque trademark for five years. This system allows for the centralization of protection across multiple territories based on a solid Monegasque trademark, although each national office retains its authority to examine and refuse applications.
The Monegasque registration is therefore not merely a territorial formality: it consolidates the owner’s rights, facilitates their defense, and paves the way for the trademark’s international expansion.
