High Commission for the Protection of Rights and Mediation: a guarantor of fundamental rights in the Principality

The High Commission for the Protection of Rights and Mediation is an independent public institution of the Principality of Monaco, established by Sovereign Order no. 10.845 of October 1, 2024. Heir to the principles of the European model of public ombudsmen, it constitutes a privileged institutional channel for the amicable settlement of administrative disputes and the defense of fundamental rights.

Its central role is to offer, free of charge, impartial recourse to any person who feels aggrieved by an administrative decision or operation, who is a victim of discrimination, or who is confronted with an infringement of his or her fundamental rights. The Haut Commissariat's intervention takes place outside any litigation procedure, in a spirit of fairness, dialogue and neutrality.

At the heart of its mission, the institution acts by means of recommendations to resolve conflictual or unfair situations in a peaceful manner. It also deploys its expertise in the protection of rights and freedoms, providing solid institutional support to the constituent, particularly when prior steps have remained ineffective.

In addition to its mediation functions, the Haut Commissariat can be called upon by administrative authorities to issue opinions on any issue relating to civil liberties or the fight against discrimination. It can also consult administrative documents in the interest of citizens, or act on its own initiative in the event of a clear breach of rights.

Through its independence, legal expertise and ability to establish constructive dialogue, the High Commission for the Protection of Rights and Mediation is an institutional pillar of Monegasque democracy, and an essential guarantor of respect for civil liberties in the Principality.
